MANILA - The criminal complaints filed by self-confessed killer Edgar Matobato against 5 policemen for torture, arbitrary detention, and violations of the rights of a detained or arrested person were dismissed by the Department of Justice (DOJ) as early as last June.<br /><br />In an 8-page resolution obtained by ABS-CBN News, dated June 30, 2016, the DOJ, through Assistant State Prosecutor Charlie Guhit, junked the charges against police Senior Superintendent Vicente Danao, Jr., SPO4 Arthur Lascañas, SPO2 Rizalino Aquino, SPO2 Bienvenido Furog, and SPO1 Reynante Medina "for insufficiency of evidence to establish probable cause."<br /><br />Danao and Medina were charged by Matobato and the National Bureau of Investigation (NBI)-Anti-organized and Transnational Crime Division-Death Investigation Unit with torture, as penalized under Republic Act (RA) No. 9745, and violations of RA No. 7438, "An Act Defining Certain Rights of Person Arrested, Detained or Under Custodial Investigation As Well As the Duties of the Arresting, Detaining and Investigating Officers, and Providing Penalties for Violations thereof."<br /><br />Lascañas, Aquino, and Furog, meantime, were charged for arbitrary detention.<br /><br />The DOJ said that while Matobato claimed that he was "unlawfully arrested and eventually detained by respondents from June 19-26," evidence, including a copy of an excerpt from the daily records of the Investigation and Detective Management Branch of the Davao City Police Office, were presented by respondent police officers that he was arrested for violation of RA No. 10591, also known as he <i>"Comprehensive Firearms and Ammunition Regulations Act."</i><br /><br /><i>"Matobato was arrested without a warrant of arrest because police officers... actually recovered from his possession and control, the following: 1) .45 caliber pistol with serial number 071250; 2) Firearm License Card with expired permit to carry ID...; and 3) three pieces of magazine of same caliber loaded with twenty nine rounds of ammunition.</i><br /><br /><i>"Well-entrenched in jurisprudence is the time-honored principle that the law bestows upon a public official the presumption of regularity in the discharge of one's official duties and functions," the resolution read.</i><br /><br />The DOJ added that given the validity of Matobato's arrest, it follows that "his detention is likewise lawful."<br /><br /><i>"Evidently, respondents have the right to detain complainant Matobato within the period provided by law or rules," the resolution read.</i><br /><br />The DOJ added that the policemen were able to file the appropriate charges against Matobato before the prosecutor's office. The case was eventually filed with the Municipal Trial Court in Cities, 11th Judicial Region, Davao City. Matobato posted bail on this charge on June 30, 2014.<br /><br />BROKEN CHEST BONE<br /><br />On the charge of torture, the DOJ said that while Matobato claimed that his alleged torture broke a bone in his chest, an NBI Medico-legal Report showed, among other findings, that the "radiologic report of chest" on June 23, 2015 gave "negative" chest injury findings or negative traces of "a healing bone or healed bone in his chest."<br /><br />The statement of his witness, Joselita Abarquez, regarding the supposed torture also fell as "hearsay," the resolution pointed out.<br /><br />The DOJ further stressed that since Matobato was discharged from the DOJ Witness Protection Program (WPP) upon his request, "there is no more material witness in this criminal case considering that no information was given... whether he still intended to pursue the case and testify against respondents."<br /><br />The DOJ resolution was approved by Senior Deputy State Prosecutor Theodore Villanueva and Prosecutor General Claro Arellano.<br /><br />Matobato hit the headlines for accusing President Duterte of being behind the so-called Davao Death Squad (DDS), of which he claims to be a former hitman.<br /><br /><br /><br /><br /><h4>

<br />MANILA, Philippines – "Maski patayin ako, hindi na ako tatakbo (Even if I get killed, I won't run away anymore)."<br /><br />Edgar Matobato, a key witness against President Rodrigo Duterte, turned emotional and broke down in tears as he testified for the second time at the Senate hearing into the rise of killings linked to the government's "war on drugs" on Thursday, September 22.<br /><br />When he first testified before the Senate committee on justice and human rights on September 15, Matobato alleged that Duterte, Davao mayor for over two decades, formed the so-called "Davao Death Squad" and himself ordered targets killed by the vigilante group.<br /><br />The Davao Death Squad is a supposed group of vigilantes that target criminals and suspects in Davao City.<br /><br />Duterte has been long linked to the group, but no charges have been filed against him. The President has "claimed" the squad to be under his command but his allies insist Duterte was just "exaggerating" when he claimed links to the group.<br /><br />Matobato turned emotional upon questioning by Senator Antonio Trillanes IV, a critic of Duterte, when he was asked to narrate how he found himself in the group.<br /><br />Matobato said that in 1977, communist rebels beheaded his father in front of him. "I grew up thinking that I would enter whatever department in government to ensure my father is given justice," Matobato said in Filipino.<br /><br />He claimed that he was initially a militia man of Davao before he was admitted into the "Lambada Boys," a group allegedly formed by Duterte that was tasked to kill criminal suspects. The group, with an initial membership of only 7 civilian hitmen, supposedly expanded to include cops and rebel returnees.<br /><br />'Where is justice?'<br /><br />Matobato claimed that his co-death squad members had tortured him – and wanted him dead – because of his plans to end his stint as a hitman. He supposedly fled Davao City because of his threats. In 2014, Matobato supposedly turned to the Department of Justice and was eventually admitted into the Witness Protection Program.<br /><br /><i>"Ang sa akin naman, ang gusto ko naman bago nila ako patayin, Sir, gusto ko naman mabigyan naman ako ng hustisya. Ang dami nilang inutos sa akin, Sir – pagpatay, pagganyan. Basta lang sila sumusugod sa akin. Tapos ang dami ko nang nalalaman, gusto naman nila akong patayin," he added.</i><br />(On my part, I was hoping that before they kill me, Sir, that I will be given justice. They ordered too many things – to kill, among others. They would just come to me. I know a lot of things, and now they want to kill me.)<br /><br />He voluntarily left the program shortly before the May 9 elections, when it became clear that Duterte would win the presidency.<br /><i><br />"Kaya pumunta ako dito kahit wala akong aral, nagkusang loob na pumunta dito, Sir....Maski patayin ako, hindi na ako tatakbo. Basta isasabi ko lang ang totoo. Totoong totoo. Hindi na ako pupunta kung hindi ako naghahanap ng hustisya. Puwede na akong magpakamatay, Sir, magbibigti ako. 'Yan ang gusto ko lang, Sir: Saan ba ang hustisya, Sir?"</i><br /><br />(That's why I came here even if I had little education, I came here voluntarily, Sir....Even if I get killed, I will not run away. I'll just tell the truth. The whole truth. I would not have come here if I weren't looking for justice. I can kill myself, Sir, I can hang myself. That's all I want, Sir. Where is justice, Sir?)<br /><br />Matobato's emotional plea came after hours of being grilled by Duterte's allies in the Senate, including senators Alan Peter Cayetano and Manny Pacquiao. MANILA, Philippines – Senator Leila de Lima said on Thursday, September 22, that a former Philippine Drug Enforcement Agency official is reportedly being pressured to testify against her.</div>
<br />She was referring to Lieutenant Colonel Ferdinand Marcelino, who was detained in January over a drug case but was released in June after the Department of Justice (DOJ) dismissed the case for lack of evidence.<br /><br />De Lima said in a press briefing on Thursday that she received two forwarded text messages sent by Marcelino to their “common acquaintance,” saying he feared for his life. One was sent on July 19, when De Lima had not yet launched a Senate probe into the killings, and the other on September 5.<br /><br />The senator said she asked for permission to share the text messages to the media following the DOJ decision to reverse its earlier ruling dismissing the case against Marcelino.<br /><br />"Mistah good pm. Magpasalamat lang sana ako sa lahat ng tulong at efforts mo for me habang ako ay nasa kulungan. I can never thank you enough mistah. Hindi pa ako masyado makagalaw at labas ngayon dahil ang dami gusto kumatay sa akin, bok,"read the text message supposedly sent in July. Mistah, in military terms, refers to a classmate at the Philippine Military Academy.<br /><br />(Classmate, good afternoon. I just want to thank you for all your help and efforts while I was still inside prison. I can never thank you enough, classmate. I still can't move and go out freely because many people want to kill me.)<br /><br />Citing the same message, De Lima said there are some groups allegedly trying to convince Marcelino to malign her through the House probe into her alleged role in the proliferation of illegal drugs in the New Bilibid Prison.<br /><br />"'Di ko pa din mapuntahan si Senator LD (Leila De Lima) kasi ginagawan kami ng mga fabricated stories (I still can't go to Senator Leila De Lima because they are fabricating stories about us.) There are also some groups who [are] trying to convince me to speak against her," it added.<br /><br />Another part read: "But rest assured na hindi ako pagagamit sa kanila mistah (I would not allow myself to be used), not only because I really appreciated and forever indebted sa inyo ni Ma'am, but because the people deserve no less than the truth and justice."<br /><br />The more recent message supposedly indicated that pressures against Marcelino are getting stronger by the day. The same groups allegedly are threatening to reopen the case against him if he would not give in to the request.<br /><br />"Mistah pressures against me are mounting and they would even reopen my case, but rest assured that I will never give in to them mistah. Please tell Senator Leila to keep faith and be strong."<br /><br />The senator said there are more text messages from her source allegedly coming from Marcelino but she has no clearance yet to publicly disclose these.<br /><br />Not true<br /><br />Hours after De Lima's announcement, Marcelino came out to the media to deny the senator's pronouncement that the government is pressuring him to testify against her.<br /><br />"I am categorically denying that anyone is pressuring me, or anyone is threatening or coercing me even from the side of the government to testify against her," Marcelino said in a news briefing with Public Attorney's Office (PAO) chief Persida Acosta.<br /><br />He, however, confirmed that the messages De Lima presented to reporters were indeed his texts to his classmate. Marcelino said he was surprised that the senator publicized the messages, saying these were clearly part of "privileged communication."<br /><br />Marcelino said the context of the messages is to boost the morale of De Lima, whom he knew on a professional basis as he worked in PDEA and she headed the justice department. He said he only wanted to lift the spirits of someone who was going through a trying time, which he had experienced in the first half of the year.<br /><br />Responding to questions, Marcelino said that someone tried to approach him – a retired government official – but he was not certain whether this person reached out to him on behalf of someone from government.<br /><br />"May sumubok na kumausap sa akin, kung may alam ako na negative sa kanya (De Lima), pero sabi ko sa kanila, 'Ako po, Sir, nakalaya ako because, I always sided with the truth. Sa lahat ng bagay, 'yun ang pinaninindigan ko, na katotohanan at puro katotohanan lamang.' Nang sinabi ko na wala akong masasabing labag sa katotohanan, hindi naman po nila ako pinilit," he said.<br /><br />(Someone tried to talk to me, if I knew anything negative about her [De Lima], but I told them, "In my case, Sir, I was released because I've always sided with the truth. I always stand by the truth and nothing but the truth." When I said that I cannot say anything that goes against the truth, they didn't force me anymore.)<br /><br />He said he was not sure whether the person who talked to him represented someone from the government. "Hindi ko alam ang real purpose niya (I don't know his real purpose) when he talked to me," he added.<br /><br />When asked, Marcelino said he was ready to participate in any congressional inquiry, where he would only "side with the truth."<br /><br />In January 2016, the DOJ under De Lima investigated a complaint of the Philippine National Police-Anti Illegal Drugs Group (PNP-AIDG) and PDEA against Marcelino for allegedly violating the Comprehensive Dangerous Drugs Act of 2002 for being in possession of P380 million worth of illegal drugs. <br /><br />Marcelino said he was only on a secret mission. The case was then dismissed in June 2016 but the PNP-AIDG and PDEA filed a motion for reconsideration. The DOJ has just reversed its ruling.<br /><br />The PAO chief said that they would file a motion to suspend the arraignment of Marcelino and the issuance of a warrant of arrest, a motion for judicial determination of probable cause, and a motion to quash.<br /><br /><br /><br /><h4>

MANILA, Philippines — High-profile convicts allegedly involved in the drug trade inside the New Bilibid Prison (NBP) are expected to testify against Senator Leila De Lima during the congressional inquiry Tuesday, September 20.<br /><br />Among the convicts reported to be part of the 14 witnesses is Herbert Colanggo.<br /><br />According to Justice Secretary Vitaliano Aguirre II, together with other convicts, Colanggo will prove that De Lima received drug money for her senatorial bid.<br /><br />De Lima, however, appeared unfazed by the supposed testimonies, stating that these are all lies.<br /><br />On Sunday, September 18, the neophyte senator announced she would neither be attending nor sending any representative or observer to the “sham inquiry.”<br /><br />But who is Colanggo? What role did he play inside Bilibid?<br /><br />Crime lord<br /><br />Herbert “Ampang” Colanggo was the leader of a notorious robbery group that had been tagged in several incidents dating back to the early 2000s.<br /><br />His robbery group was also reported to have worked with other syndicates. Some reports, however, also identify him as the leader of the Ozamiz robbery gang.<br /><br />The Ampang Colanggo robbery group was tagged as being behind the Rizal Commercial Banking Corporation (RCBC) branch in Cabuyao, Laguna in 2008 which left 10 individuals dead. The incident is identified as one of the bloodiest bank robberies in Philippine history.<br /><br />After years of being elusive despite a string of bank robberies reportedly conducted by his group, Colanggo was finally arrested in January 2009 in a checkpoint at Barangay Tominobo, Iligan City.<br /><br />In October 2014, the Parañaque Regional Trial Court sentenced Colanggo to life imprisonment.<br /><br />However, his arrest and eventual conviction did not put an end to his group’s work. Several bank robberies after 2009 were continuously linked to members of the Ampang Colanggo robbery group.<br /><br />Herbert the artist<br /><br />Colanggo is part of Bilibid 19, a group of high-profile, privileged inmates who had access to illegal drugs, firearms, drug paraphernalia, firearms, flat screen TVs, sex toys, and pornography, among others.<br /><br />Inside Bilibid, Colanggo built a life around his ambition of becoming a recording artist, following in the footsteps of his idols Michael Jackson, Martin Nievera, and Freddie Aguilar, among others.<br /><br />The extent of Colanggo’s musical career was discovered during a series of surprise inspections led by then justice secretary De Lima.<br /><br />The convicted crime lord rebranded himself as “Herbert C” and even released an album entitled “Kinabukasan” (Future) – all produced through a complete recording studio inside the country’s maximum security prison.<br /><br />A music video for one of the songs, "Pano ‘Yon," was even filmed with what appeared to be a complete crew inside his music studio.<div class="p1" style="box-sizing: border-box; line-height: 1.5; margin-bottom: 24px; margin-top: 8px;">

Colanggo was even named the New Male Recording Artist of the Year in 2014 by the Philippine Movie Press Club (PMPC).<br /><br />The discovery of the 19 inmates’ luxurious living inside Bilibid ended the musical aspirations of Colanggo. The facilities were dismantled and the inmates were transferred to different facilities to hopefully lead to the “demise of syndicates inside the prison.”<br /><br />However, contraband items such as cigarettes and cash were still found inside Bilibid in subsequent inspections.<div class="separator" style="clear: both; text-align: center;">

On July 7, President Rodrigo Duterte named Colanggo as one of the drug lords operating inside Bilibid, threatening him and Peter Co with death if they step out of jail.<br /><br />Ozamiz City mayor Reynaldo Parojinog Sr, one of the local government officials Duterte linked to drugs, is the father of Colanggo’s reported girlfriend, Ozamiz City Vice Mayor Nova Princess Parojinog.<br /><br />The elder Parojinog, however, denied any involvement with illegal drugs and said he disapproves of his daughter’s relationship with the alleged drug lord. Nova Princess' marriage to former basketball player Edgar Echavez has been annulled.<br /><br />The existence and flow of illegal drugs inside Bilibid was largely blamed on De Lima.<br /><br />According to reports, Colanggo executed an affidavit claiming that De Lima was given millions by drug lords in exchange for allowing drug convicts inside the state penitentiary to continue their illegal operations.<br /><br />The Department of Justice (DOJ) is already eyeing criminal raps against De Lima over her alleged links to the illegal drug trade. MANILA, Philippines – No one but President Rodrigo Duterte should be blamed for the Philippines’ bad image in the international community.<br /><br />This was Senator Leila de Lima's statement in her privilege speech on Tuesday, September 20, as she cried foul anew over Senator Alan Peter Cayetano’s allegations that she is “misleading” international media and creating a negative image of the Philippines abroad.<div>
<br />“And may I add, the President has already proven that he is more than capable of single-handedly giving a bad image of this country to the whole world in the short span of 3 months in office. He does not need any help from anybody on that aspect, least of all from me,” De Lima said in her privilege speech.<br /><br />De Lima reiterated that the extrajudicial killings were the problem, and not herself.<br /><br />“Ang pagpatay ng mahigit 30 katao araw-araw ay pagpatay pa rin sa mata ng mundo, nandiyan man si Leila De Lima o wala,” she said.<br /><br />(The killing of more than 30 people every day is still a killing in the eyes of the world, whether or not Leila de Lima is there.)<br /><br />De Lima said this was worsened by the President's foul mouth. Duterte earlier cursed Pope Francis over the heavy traffic in the metro when he arrived in 2015. He also insulted US President Barack Obama for criticizing the human rights stance of the administration.<br /><br />Don’t twist the story<br /><br />De Lima said Duterte’s allies should not twist the story. It is clear, she said, who was at fault.<br /><br />“Kaya huwag po ninyong baligtarin ang mundo, na ako ang nagbibigay ng masamang imahe sa Pilipinas dahil hindi ako ang nagmura kay Obama at Ban Ki Moon,” De Lima said.<br /><br />(So please don't turn the world around, that I am the one giving the Philippines a bad image, because I was not the one who cursed Obama and Ban Ki Moon.)<br /><br />She urged the President’s allies to look clearly ahead of them and see who the real culprit is.<br /><br />The President, she said, should be called out by his circle for his “uncontrollable mouth.”<br /><br />“Minsan ay tanggalin naman ninyo ang mga tapaloda ng kabayo sa inyong mga mata at medyo punahin naman ninyo kahit konti ang walang kontrol na bunganga ng inyong Pangulong pinagtatanggol,” she said.<br /><br />(You better remove the horses' blinders on your eyes and criticize, even for a bit, the uncontrollable mouth of your protected President.)<br /><br />Even with her ouster as Senate justice committee chairperson, De Lima said Cayetano – one of Duterte’s staunchest allies in the Senate – could not expect the improvement of the country’s international image in an instant.<br /><br />If Cayetano still would insist on that, he must be “dreaming,” De Lima said.<br /><br /><br /><div style="text-align: center;">

(We did not promise them anything.) We are not in a position to give anything or to promise anything except na iyung mga testimony ninyo ay hindi magagamit sa inyo (your testimonies will not be used against you)," he told radio DZMM.<br /><br />He said the inmates themselves are not expecting any favor for narrating how money was collected from them to allegedly fund de Lima’s 2016 senate bid.<br /><br />"Itong mga inmates na ito, napakahaba ng mga sentensya, 'yung iba siguro rito, may life pa. Wala na silang inaasahan except that makatulong sila," the Justice chief said. (These inmates have long prison sentences, some of them were sentenced to life. They are not axpecting anything except that they will help the investigation.)<br /><br />The inmates set to appear at the House probe have been transferred from the New Bilibid Prisons to a maximum security facility inside military headquarters because of security concerns, Aguirre added.<br /><br />Two of the inmates testifying against the senator are crime kingpins Herbert Colangco and Noel Martinez. They are set to reveal how a fellow inmate, Jaybee Sebastian, allegedly directed them to sell large amounts of "shabu" as early as 2013 to contribute to then de Lima's campaign kitty.<br /><br />A high-ranking government official will also testify that he delivered millions in drug payoffs to de Lima's house in Parañaque, Aguirre said.<br /><br />De Lima is leading a Senate investigation into the thousands of deaths linked to Duterte's war on drugs.<br /><br />Last week, she presented as witness Edgar Matobato, a self-confessed hitman who accused Duterte of ordering the killings of suspected criminals and political opponents in Davao City during his term as mayor.</span><div style="font-family: franklin-gothic-urw, Arial, "Helvetica Neue", Helvetica, sans-serif; line-height: 1.5; padding: 10px 0px;">

Cayetano also questioned the neutrality of De Lima to conduct the hearing, claiming that she had already judged the Duterte administration "guilty" even before the hearing began.</div>

Edgar Matubato, a former army militia, told a Senate hearing that he was recruited to a hit squad called the "Lambada Boys" alongside five others in 1988, when Duterte started his first term.</div>

Under questioning by Sen. Leila de Lima, a staunch critic of Duterte's bloody war on drugs, Matubato said he killed around 50 people from 1988 to 2013.</div>

Matubato also accused Duterte of ordering a bomb attack on a Davao City mosque in 1993. The mayor, he said, believed Muslims were behind an explosion at the Cathedral of Davao City earlier that year.</div>

[I was at the office. I was always beside the officials. He may be seeking revenge for the bombing of the cathedral]."</div>

But there were no injuries since there was no worship service at the mosque during the attack so Duterte ordered the hit squad to "capture" and "kill" suspects in the cathedral blast, Matubato said.</div>

Matubato said the death squad was also behind the killing of foreign terror suspect Sali Makdum in 2002.</div>

With their alleged team leader police officer Arthur Lascañas, the witness, said they kidnapped Makdum from Samal City and brought him to the Davao City police office, then headed by Ronald "Bato" Dela Rosa who is now director of the Philippine National Police.</div>
