MANILA, Philippines (UPDATED) – At least one <a href="http://getupdatedph.blogspot.com/2016/09/read-duterte-eyes-return-of-philippine.html">high</a>-<a href="http://getupdatedph.blogspot.com/2016/09/read-duterte-eyes-return-of-philippine.html">profile</a> inmate at the New Bilibid Prison died Wednesday, September 28, after a “riot” erupted between inmates earlier in the morning.<br />
<br />
In radio and television interviews, Justice Secretary Vitaliano Aguirre II confirmed that a certain Tony Co, an inmate at Bilibid, died after the riot at Building 14.<br />
<br />
Other high-profile inmates – Peter Co, Vicente Sy, Jaybee Sebastian –<a href="http://www.rappler.com/nation/146926-jaybee-sebastian-law-ruled-bilibid"> </a>and retired police Chief Inspector Clarence Dongail were also injured, according to Aguirre.<br />
<br />
Co, Sy, and Sebastian were taken to the Medical Center Muntinlupa. The Dongail was also hurt, Aguirre said, but did not want to be brought to a hospital and chose to be treated at the Bilibid.<br />
<br />
Co is supposedly 50/50 while <a href="http://getupdatedph.blogspot.com/2016/09/read-duterte-eyes-return-of-philippine.html">Sebastian </a>is “stable,” according to Aguirre.<br />
<br />
Citing what he called "sketchy, initial reports," Aguirre said the two Cos and Sy were reportedly using shabu at the cell of Peter Co. An inmate, Edgar Cinco, saw them, and reported them Dongail.<br />
<br />
Dongail reportedly called out the group for using illegal drugs, and then went to the cell of Sebastian. Tony Co supposedly ran after Dongail and attempted to attack him.<br />
<br />
"There was a riot," Aguirre said, adding that an "<a href="http://getupdatedph.blogspot.com/2016/09/read-duterte-eyes-return-of-philippine.html">icepick</a>" was used.<br />
<br />
In the end, Tony Co was killed. Sy, Peter Co, and Sebastian were also hurt enough to require hospitalization, said the justice secretary.<br />
<br />
Dongail, who was the reported subject of the attack and was supposed to have been stabbed as well, according to Aguirre, was not included in the list of injured in the official statement released by Justice Undersecretary Ericcson Balmes.<br />

Aguirre: Sebastian should live<br />
<br />
Asked how shabu could still exist in the Bilibid, when it was already being guarded by the Philippine National Police-Special Action Force troopers, Aguirre said the problem could not be completely wiped out at once.<br />
<br />
Responding to questions, Aguirre said Peter and Tony Co, and Sy, are serving time for drug-related offenses. "They are considered among the biggest drug traders in the country," he said.<br />
<br />
Asked if he planned to go to Bilibid following the incident, Aguirre said he had no time as he was part of the presidential <a href="http://getupdatedph.blogspot.com/2016/09/read-duterte-eyes-return-of-philippine.html">delegation</a> to Vietnam, where President Rodrigo Duterte will have a working starting. They were due to leave early Wednesday afternoon.<br />

Then he said, "Ang masasabi ko lang ito ay hindi maganda sa gobyerno na mamatay si Jaybee Sebastian dahil 'yan ang talagang inaasahan namin na siya ang magspill ng beans, diretso 'yan kay Secretary De Lima eh. So ayaw naming mamatay 'yan, gusto naming buhay siya."<br />

He said Sebastian has not agreed to give full testimony at the House inquiry into the drug trade at the Bilibid when De Lima was justice secretary. Aguirre said Sebastian has not been subpoenaed to appear before the House committee on justice.<br />

‪All inmates were detained at the Building 14 inside the NBP, which houses "<a href="http://getupdatedph.blogspot.com/2016/09/read-duterte-eyes-return-of-philippine.html">high-profile</a>" inmates, including those alleged to have continued drug operations inside prison. ‬<br />

Co is among the detainees President Rodrigo Duterte accused of still being a drug lord in incarceration. Co is a convicted drug lord.‬<br />
<br />
‪Sebastian is supposedly one of the most influential gang leaders in Bilibid. He has also been accused of helping Senator Leila de Lima, then justice secretary, raise campaign funds within the prison through illegal drugs, which De Lima had denied. Sebastian is serving time for carnapping.<br />
<br />
De Lima had said that Sebastian was a government asset.<br />

<b>House Bill (HB) Number 3605 was filed by Speaker Pantaleon Alvarez, Majority Leader Rodolfo Fariñas, Minority Leader Danilo Suarez, and Kabayan Representative Harry Roque, who is part of the minority bloc.</b><br />
<b><br /></b>
<b>As of Monday, September 26, another 52 lawmakers have supported the measure.</b><br />
<b>HB Number 3605 seeks to add the following lines to Section 13 of Republic Act (RA) Number 3019 or the Anti-Graft and Corrupt Practices Act: "That in case such incumbent public officer is no longer connected with the office wherein the offense charged was committed, the preventive suspension order shall no longer be implemented."</b><br />
<b><br /></b>
<b>The proponents of the bill reasoned that RA Number 3019 was enacted "with the laudable intent of breathing life into the time-honored principle that a public office is a public trust."</b><br />
<b><br /></b>
<b>"As preventive suspension is imposed to prevent an accused from influencing potential witnesses or tampering with records, the change in circumstances of the public officers effectively removes this threat, making the provision in line with the spirit and intent of the law," said Alvarez, Fariñas, Suarez, and Roque in their explanatory note.</b><br />
<b><br /></b>
<b>The bill was filed after preventive suspension orders were separately ordered against Pangasinan 5th District Representative Amado Espino Jr and Camarines Sur 2nd District Representative Luis Raymund Villafuerte.</b><br />

<b>Anti-graft court Sandiganbayan ordered Espino's suspension for allegedly allowing illegal black sand mining operations in Pangasinan in 2011, back when he was still governor.</b><br />
<b><br /></b>
<b>Villafuerte faces graft charges for supposedly allowing the payment for petroleum products to Naga Fuel Express Zone without proper bidding when he was still governor.</b><br />

<b>The House of Representatives then held an all-members caucus, where it was decided that the House committee on rules would discuss what actions to take over the 90-day suspension orders against the two lawmakers.</b><br />

<b>Fariñas earlier explained that the House's historical practice is to not implement suspension orders issued against congressmen over cases involving their previous positions.</b><br />

<b>But Alvarez gave an assurance that they would uphold the law concerning the suspensions of Espino and Villafuerte.</b><br />

<span style="font-family: inherit;"><b><br />MANILA, Philippines –The chairman of the House committee on justice on Saturday, September 24, defended the convicts testifying against Senator Leila de Lima on the alleged illegal drug trade in the New Bilibid Prison (NBP).<br /><br />Oriental Mindoro 2nd District Representative Reynaldo Umali said, <i>"Does she expect angels to squeal?"</i><br /><br />Umali explained: <i>"We summoned witnesses who have first-hand knowledge of the illegal activities in prison. Who else can they be but convicted criminals themselves?"</i><br /><br />This comes as De Lima claims the Duterte administration pressured convicts to testify against her at the ongoing probe House probe on the alleged proliferation of the drug trade at the NBP when she was justice secretary.<br /><br />All the convicts, as well as some other witnesses who were presented at the congressional inquiry, were granted immunity from suit for anything they may say at the hearings.<br /><br />President Rodrigo Duterte said this probe shows he <i>"was correct all along"</i> in linking De Lima to illegal drugs.<br /><br />De Lima, however, said on Tuesday, September 20, "Prisoners are being selected and isolated just to be intimidated into implicating me and to fit the President’s narrative that I am a drug lord coddler, aside from being the most evil woman in the planet."<br /><br />Umali, in turn, pointed out on Saturday: <i>"We are conducting an investigation in aid of legislation on the extent and magnitude of the illegal drug trade right within the biggest prison facility in the country. The Bureau of Corrections that oversees the NBP is under the Department of Justice, which she headed during the previous administration."</i><br /><br />"If she really wants to clear her name and help government stop the proliferation of illegal drugs not just in the NBP but also in the entire country, then she may wish to appear in our next hearing instead of casting aspersions on the integrity of our probe through media," Umali said.<br /><br />In a news briefing on Thursday, De Lima praised how Umali had conducted the congressional inquiry, so far.<br /><br /><i>"Representative Umali is rather fair in handling the proceedings," she said.</i><br /><br />De Lima said that Umali is one of the godfathers of her eldest son, and a fraternity bother. MANILA, Philippines – Senator Leila De Lima on Friday, September 23, called Justice Secretary Vitaliano Aguirre II “stupid” for apparently not seeing government's inconsistent moves in its fight against illegal drugs.<br /><br />De Lima was reacting to the House inquiries into her alleged role in the proliferation of illegal drugs in the New Bilibid Prison, the Philippines' national penitentiary in Muntinlupa, Metro Manila.<br /><br />She questioned why Aguirre was allowed to cross-examine the same witnesses, mostly drug convicts, that he brought to testify against her. <br /><br />“The House allows Aguirre to conduct the examination of his own witnesses, while in the Senate, Matobato is subjected to uninhibited, gruelling cross-examination, at times with misleading questions designed to confuse a Grade 1 dropout,” De Lima said in a text message to reporters.<br /><br />Edgar Motabato is the self-confessed hitman of the Davao Death Squad who accused President Rodrigo Duterte of ordering killings when he was Davao City mayor. <br /><br />It is ironic, De Lima said, that the Duterte administration is now partnering with drug lords in its drug war when it once accused them of plotting to kill the President.<br /><br /><i>“Kasi daw ang mga drug lord at criminal sa Bilibid ngayon ay kakampi na ng Pangulo sa kanyang giyera sa droga,” De Lima said. MANILA - The criminal complaints filed by self-confessed killer Edgar Matobato against 5 policemen for torture, arbitrary detention, and violations of the rights of a detained or arrested person were dismissed by the Department of Justice (DOJ) as early as last June.<br /><br />In an 8-page resolution obtained by ABS-CBN News, dated June 30, 2016, the DOJ, through Assistant State Prosecutor Charlie Guhit, junked the charges against police Senior Superintendent Vicente Danao, Jr., SPO4 Arthur Lascañas, SPO2 Rizalino Aquino, SPO2 Bienvenido Furog, and SPO1 Reynante Medina "for insufficiency of evidence to establish probable cause."<br /><br />Danao and Medina were charged by Matobato and the National Bureau of Investigation (NBI)-Anti-organized and Transnational Crime Division-Death Investigation Unit with torture, as penalized under Republic Act (RA) No. 9745, and violations of RA No. 7438, "An Act Defining Certain Rights of Person Arrested, Detained or Under Custodial Investigation As Well As the Duties of the Arresting, Detaining and Investigating Officers, and Providing Penalties for Violations thereof."<br /><br />Lascañas, Aquino, and Furog, meantime, were charged for arbitrary detention.<br /><br />The DOJ said that while Matobato claimed that he was "unlawfully arrested and eventually detained by respondents from June 19-26," evidence, including a copy of an excerpt from the daily records of the Investigation and Detective Management Branch of the Davao City Police Office, were presented by respondent police officers that he was arrested for violation of RA No. 10591, also known as he <i>"Comprehensive Firearms and Ammunition Regulations Act."</i><br /><br /><i>"Matobato was arrested without a warrant of arrest because police officers... actually recovered from his possession and control, the following: 1) .45 caliber pistol with serial number 071250; 2) Firearm License Card with expired permit to carry ID...; and 3) three pieces of magazine of same caliber loaded with twenty nine rounds of ammunition.</i><br /><br /><i>"Well-entrenched in jurisprudence is the time-honored principle that the law bestows upon a public official the presumption of regularity in the discharge of one's official duties and functions," the resolution read.</i><br /><br />The DOJ added that given the validity of Matobato's arrest, it follows that "his detention is likewise lawful."<br /><br /><i>"Evidently, respondents have the right to detain complainant Matobato within the period provided by law or rules," the resolution read.</i><br /><br />The DOJ added that the policemen were able to file the appropriate charges against Matobato before the prosecutor's office. The case was eventually filed with the Municipal Trial Court in Cities, 11th Judicial Region, Davao City. Matobato posted bail on this charge on June 30, 2014.<br /><br />BROKEN CHEST BONE<br /><br />On the charge of torture, the DOJ said that while Matobato claimed that his alleged torture broke a bone in his chest, an NBI Medico-legal Report showed, among other findings, that the "radiologic report of chest" on June 23, 2015 gave "negative" chest injury findings or negative traces of "a healing bone or healed bone in his chest."<br /><br />The statement of his witness, Joselita Abarquez, regarding the supposed torture also fell as "hearsay," the resolution pointed out.<br /><br />The DOJ further stressed that since Matobato was discharged from the DOJ Witness Protection Program (WPP) upon his request, "there is no more material witness in this criminal case considering that no information was given... whether he still intended to pursue the case and testify against respondents."<br /><br />The DOJ resolution was approved by Senior Deputy State Prosecutor Theodore Villanueva and Prosecutor General Claro Arellano.<br /><br />Matobato hit the headlines for accusing President Duterte of being behind the so-called Davao Death Squad (DDS), of which he claims to be a former hitman.<br /><br /><br /><br /><br /><h4>

<br />MANILA, Philippines – "Maski patayin ako, hindi na ako tatakbo (Even if I get killed, I won't run away anymore)."<br /><br />Edgar Matobato, a key witness against President Rodrigo Duterte, turned emotional and broke down in tears as he testified for the second time at the Senate hearing into the rise of killings linked to the government's "war on drugs" on Thursday, September 22.<br /><br />When he first testified before the Senate committee on justice and human rights on September 15, Matobato alleged that Duterte, Davao mayor for over two decades, formed the so-called "Davao Death Squad" and himself ordered targets killed by the vigilante group.<br /><br />The Davao Death Squad is a supposed group of vigilantes that target criminals and suspects in Davao City.<br /><br />Duterte has been long linked to the group, but no charges have been filed against him. The President has "claimed" the squad to be under his command but his allies insist Duterte was just "exaggerating" when he claimed links to the group.<br /><br />Matobato turned emotional upon questioning by Senator Antonio Trillanes IV, a critic of Duterte, when he was asked to narrate how he found himself in the group.<br /><br />Matobato said that in 1977, communist rebels beheaded his father in front of him. "I grew up thinking that I would enter whatever department in government to ensure my father is given justice," Matobato said in Filipino.<br /><br />He claimed that he was initially a militia man of Davao before he was admitted into the "Lambada Boys," a group allegedly formed by Duterte that was tasked to kill criminal suspects. The group, with an initial membership of only 7 civilian hitmen, supposedly expanded to include cops and rebel returnees.<br /><br />'Where is justice?'<br /><br />Matobato claimed that his co-death squad members had tortured him – and wanted him dead – because of his plans to end his stint as a hitman. He supposedly fled Davao City because of his threats. In 2014, Matobato supposedly turned to the Department of Justice and was eventually admitted into the Witness Protection Program.<br /><br /><i>"Ang sa akin naman, ang gusto ko naman bago nila ako patayin, Sir, gusto ko naman mabigyan naman ako ng hustisya. Ang dami nilang inutos sa akin, Sir – pagpatay, pagganyan. Basta lang sila sumusugod sa akin. Tapos ang dami ko nang nalalaman, gusto naman nila akong patayin," he added.</i><br />(On my part, I was hoping that before they kill me, Sir, that I will be given justice. They ordered too many things – to kill, among others. They would just come to me. I know a lot of things, and now they want to kill me.)<br /><br />He voluntarily left the program shortly before the May 9 elections, when it became clear that Duterte would win the presidency.<br /><i><br />"Kaya pumunta ako dito kahit wala akong aral, nagkusang loob na pumunta dito, Sir....Maski patayin ako, hindi na ako tatakbo. Basta isasabi ko lang ang totoo. Totoong totoo. Hindi na ako pupunta kung hindi ako naghahanap ng hustisya. Puwede na akong magpakamatay, Sir, magbibigti ako. 'Yan ang gusto ko lang, Sir: Saan ba ang hustisya, Sir?"</i><br /><br />(That's why I came here even if I had little education, I came here voluntarily, Sir....Even if I get killed, I will not run away. I'll just tell the truth. The whole truth. I would not have come here if I weren't looking for justice. I can kill myself, Sir, I can hang myself. That's all I want, Sir. Where is justice, Sir?)<br /><br />Matobato's emotional plea came after hours of being grilled by Duterte's allies in the Senate, including senators Alan Peter Cayetano and Manny Pacquiao. MANILA, Philippines – Senator Leila de Lima said on Thursday, September 22, that a former Philippine Drug Enforcement Agency official is reportedly being pressured to testify against her.</div>
<br />She was referring to Lieutenant Colonel Ferdinand Marcelino, who was detained in January over a drug case but was released in June after the Department of Justice (DOJ) dismissed the case for lack of evidence.<br /><br />De Lima said in a press briefing on Thursday that she received two forwarded text messages sent by Marcelino to their “common acquaintance,” saying he feared for his life. One was sent on July 19, when De Lima had not yet launched a Senate probe into the killings, and the other on September 5.<br /><br />The senator said she asked for permission to share the text messages to the media following the DOJ decision to reverse its earlier ruling dismissing the case against Marcelino.<br /><br />"Mistah good pm. Magpasalamat lang sana ako sa lahat ng tulong at efforts mo for me habang ako ay nasa kulungan. I can never thank you enough mistah. Hindi pa ako masyado makagalaw at labas ngayon dahil ang dami gusto kumatay sa akin, bok,"read the text message supposedly sent in July. Mistah, in military terms, refers to a classmate at the Philippine Military Academy.<br /><br />(Classmate, good afternoon. I just want to thank you for all your help and efforts while I was still inside prison. I can never thank you enough, classmate. I still can't move and go out freely because many people want to kill me.)<br /><br />Citing the same message, De Lima said there are some groups allegedly trying to convince Marcelino to malign her through the House probe into her alleged role in the proliferation of illegal drugs in the New Bilibid Prison.<br /><br />"'Di ko pa din mapuntahan si Senator LD (Leila De Lima) kasi ginagawan kami ng mga fabricated stories (I still can't go to Senator Leila De Lima because they are fabricating stories about us.) There are also some groups who [are] trying to convince me to speak against her," it added.<br /><br />Another part read: "But rest assured na hindi ako pagagamit sa kanila mistah (I would not allow myself to be used), not only because I really appreciated and forever indebted sa inyo ni Ma'am, but because the people deserve no less than the truth and justice."<br /><br />The more recent message supposedly indicated that pressures against Marcelino are getting stronger by the day. The same groups allegedly are threatening to reopen the case against him if he would not give in to the request.<br /><br />"Mistah pressures against me are mounting and they would even reopen my case, but rest assured that I will never give in to them mistah. Please tell Senator Leila to keep faith and be strong."<br /><br />The senator said there are more text messages from her source allegedly coming from Marcelino but she has no clearance yet to publicly disclose these.<br /><br />Not true<br /><br />Hours after De Lima's announcement, Marcelino came out to the media to deny the senator's pronouncement that the government is pressuring him to testify against her.<br /><br />"I am categorically denying that anyone is pressuring me, or anyone is threatening or coercing me even from the side of the government to testify against her," Marcelino said in a news briefing with Public Attorney's Office (PAO) chief Persida Acosta.<br /><br />He, however, confirmed that the messages De Lima presented to reporters were indeed his texts to his classmate. Marcelino said he was surprised that the senator publicized the messages, saying these were clearly part of "privileged communication."<br /><br />Marcelino said the context of the messages is to boost the morale of De Lima, whom he knew on a professional basis as he worked in PDEA and she headed the justice department. He said he only wanted to lift the spirits of someone who was going through a trying time, which he had experienced in the first half of the year.<br /><br />Responding to questions, Marcelino said that someone tried to approach him – a retired government official – but he was not certain whether this person reached out to him on behalf of someone from government.<br /><br />"May sumubok na kumausap sa akin, kung may alam ako na negative sa kanya (De Lima), pero sabi ko sa kanila, 'Ako po, Sir, nakalaya ako because, I always sided with the truth. Sa lahat ng bagay, 'yun ang pinaninindigan ko, na katotohanan at puro katotohanan lamang.' Nang sinabi ko na wala akong masasabing labag sa katotohanan, hindi naman po nila ako pinilit," he said.<br /><br />(Someone tried to talk to me, if I knew anything negative about her [De Lima], but I told them, "In my case, Sir, I was released because I've always sided with the truth. I always stand by the truth and nothing but the truth." When I said that I cannot say anything that goes against the truth, they didn't force me anymore.)<br /><br />He said he was not sure whether the person who talked to him represented someone from the government. "Hindi ko alam ang real purpose niya (I don't know his real purpose) when he talked to me," he added.<br /><br />When asked, Marcelino said he was ready to participate in any congressional inquiry, where he would only "side with the truth."<br /><br />In January 2016, the DOJ under De Lima investigated a complaint of the Philippine National Police-Anti Illegal Drugs Group (PNP-AIDG) and PDEA against Marcelino for allegedly violating the Comprehensive Dangerous Drugs Act of 2002 for being in possession of P380 million worth of illegal drugs. <br /><br />Marcelino said he was only on a secret mission. The case was then dismissed in June 2016 but the PNP-AIDG and PDEA filed a motion for reconsideration. The DOJ has just reversed its ruling.<br /><br />The PAO chief said that they would file a motion to suspend the arraignment of Marcelino and the issuance of a warrant of arrest, a motion for judicial determination of probable cause, and a motion to quash.<br /><br /><br /><br /><h4>

<br />MANILA, Philippines – “Ang batas ni Jaybee, nasusunood doon sa (Jaybee’s law is what’s followed inside) [New Bilibid Prison].”<br /><br />Noel Martinez, an inmate inside the New Bilibid Prison (NBP), said he did not want to have anything to do with illegal drugs while incarcerated, but upon the orders of Jaybee Sebastian, a co-inmate, he had no other choice but to find a way to deal narcotics. The proceeds, Martinez claimed, would be used for then justice secretaryLeila de Lima’s 2016 senatorial bid.<br /><br />Martinez made the disclosure on Wednesday, September 21, during the House of Representatives’ probe into allegations that the illegal drug trade flourished inside what was supposed to be a maximum-security prison during De Lima’s stint as justice secretary. Bilibid is managed by the Bureau of Corrections which is under the justice department.<br /><br />Asked why Sebastian was so influential inside Bilibid, Martinez claimed this was because of his supposed close ties to De Lima. Sebastian is also the leader of the Sigue-Sigue Commando Group.<br /><br />Martinez is only one of several inmates brought to testify against De Lima in the legislative hearing. All of the witnesses, convicts and National Bureau of Investigation (NBI) officials, were granted immunity from suit in the context of their testimonies by Congress. Other convicts claimed De Lima herself visited Sebastian’s “kubol” inside Bilibid, sometimes to collect proceeds from drug sales.<br /><br />Sebastian was also feared for his violent streak, said Martinez, who claimed that the gang leader once had someone “hammered on the head” inside prison. “You will just follow what he says to avoid conflict,” said Martinez of Sebastian.<br /><br />Martinez also lamented De Lima’s supposed preferential treatment for select inmates, particularly when the NBI raided the Maximum Security Compound in December 2014. De Lima singled out the “Bilibid 19,” high-profile inmates with supposed links to illegal drugs.<br /><br />“That’s my grudge against De Lima, she did not investigate well. Many of the ‘Bilibid 19’ aren’t even linked to drugs. Why was I included? That’s my question. Why was I included while [Sebastian] grew his business inside?” said Martinez. Proof of his unwillingness to be involved in drugs, he said, was his refusal to peddle 200 grams of drugs, despite Sebastian’s orders.<br /><br />It was supposedly Sebastian himself who fed De Lima information on who to isolate and list as part of the “Bilibid 19.” Martinez said Sebastian included Chinese nationals without links to drugs in the list, while excluding Chinese nationals whom he transacted with.<br /><br />Martinez, who heads the Genuine Ilocano Group inside Bilibid, said it was his job to “punish” inmates caught using illegal drugs. <br /><br /><br /><br /><br /><br /><br /></span><h4>
